PRIVACY POLICY

Please read this Privacy Policy completely and carefully.

This Privacy Policy describes the policies and procedures of Coldbrew Cloud LLC (“we”, “our” or “us”) on the collection, storage, use, and disclosure of your information on coldrewcloud.com (the “Site”) and the services, features, content or applications we offer (collectively with the Site, the “Services”).

We get information about you from a number of sources, including: (1) yourself, if you register for the Site and the Services, through your user account on the Services (your “Account”); (ii) your general use of the Services; and (iii) from third party websites and services. When you use the Services, you are consenting to the collection, transfer, manipulation, storage, disclosure and other uses of your information as described in this Privacy Policy.

Any terms used but not defined in this Privacy Policy have the meanings set forth in our Terms and Conditions, available at here.

Coverage

This Privacy Policy covers the treatment of personally identifiable information, confidential or not (“Personal Info”), gathered when you are using or accessing the Services. This Privacy Policy also governs our treatment of any Personal Info that our business partners share with us or that we share with our business partners.

This Privacy Policy does not apply to the practices of third parties that we do not own, manage, or otherwise control, including but not limited to any third party websites, services, and applications (“Third Party Services”) that you choose to access through the Service, including our Payment Processor, or to individuals that we do not manage or employ.

While we try to facilitate access only to those Third Party Services that share our respect for your privacy, we cannot take responsibility for the content or privacy policies of those Third Party Services. They or you bear the sole responsibility for your privacy in such cases. Hence, we encourage you to carefully review the privacy policies of any Third Party Services you access before doing so.

Information collected

The information we gather allows us to improve, personalize, modify, build upon, and continue to operate the Services. In connection with certain aspects of the Services, we may request, collect and/or display some of your Personal Info. We collect the following types of information from our users:

Account Information:

When you create an Account, you will be asked to provide information that could be Personal Info, such as your username, password and email address. You acknowledge that this information may be personal to you, and by creating an Account on the Services and providing Personal Info to us, you allow others, including us, to identify you and therefore you may not be anonymous.

We may use your contact information to send you information about our Services, from time to time, but only when we feel such information is important. You may choose to unsubscribe from these messages through your Account settings, although we, regardless, reserve the right to contact you when we believe it is necessary, such as for account recovery purposes.

User Content and Information:

Some features of the Services allow you to provide content to the Services, such as written comments and feedback. All content submitted by you to the Services may be retained by us indefinitely, even after you terminate your account. We do not have an obligation to erase or discard any of such content submitted by you. We may also continue to disclose such content to third parties in a manner that does not disclose Personal Info, as described in this Privacy Policy.

You may elect to provide, and will provide if you become a winning buyer of goods listed through the Site, information that could be Personal Info, such as your name, mailing address, phone number and email address. You acknowledge that some or all of this information may be personal to you, and by providing Personal Info to us, you allow others, including us and applicable Sellers, to identify you, and therefore you may not be anonymous.

IP Address Information and Other Information:

Our systems automatically receive, record, and store information from your web browser when you interact with the Services, including your IP address and cookie information. This information is used for fighting spam/malware and also to facilitate collection of data concerning your interaction with the Services (e.g., what links you have clicked on).

In general, the Services automatically collect usage information, such as the number and frequency of visitors to the Site. We may use this data in aggregate form, that is, as a statistical measure, but not in a manner that would identify you personally. This type of data allows us and third parties authorized by us to study how often individuals use different parts of the Services so that we can improve them.

Financial Information:

We do not currently collect financial information, such as your payment method (credit card information or other financial information).

Financial information is collected and stored by a third party payment processing company (the “Payment Processor”), the Payment Processor’s applicable terms of service and privacy policy governs the use and storage of such information.

Email Communications:

We may receive a “read receipt” when you open an email from us. This means we may be notified when you open an email from us. This is to improve our customer service for our users.

Cookies:

Cookies are pieces of text and other information that may be provided to your computer through your web browser when you access a website. The browser you use may store cookies associated with each website you visit. We use cookies to enable our servers to recognize your web browser and tell us how and when you visit the Site and otherwise use the Services through the Internet.

Our cookies do not, by themselves, contain Personal Info, and we do not combine the general information collected through cookies with other Personal Info to tell us who you are. As noted above, however, we do use cookies to identify that your web browser has accessed aspects of the Services and may associate that information with your Account if you have one.

Most browsers have an option for turning off the cookie feature. Turning off cookies will prevent your browser from gathering cookies. and from accepting new cookies. (Browsers also allow you to erase stored cookies.) It is up to you whether you want to leave cookies active. However, doing so will allow you to take use the Site and Services more fully, as we intend.

This Privacy Policy only covers our use of cookies. It does not apply to the use of cookies by third parties – we do not control when, how, or why third parties place cookies on your computer.

Aggregate Information:

We collect statistical information about how both unregistered and registered users, collectively, use the Services (“Aggregate Information”). Some of this information is taken from Personal Info. This statistical information is not Personal Info and cannot be tied back to you.

Social Networks:

Sometimes you can use your Account on our Services to interact with your personal social media accounts, such as Facebook or Twitter. For example, you can use a “share” button that allows you to post information to your social networks outside of the Services (“Share”). After posting a Listing on the Services, you can Share information about that Listing with your Facebook friends or Twitter followers. Please note that these social media sharing tools may be operated by Third Party Services.

By using these tools, you acknowledge that the Third Party Service that operates the tool may be collecting information about your browser or online activity through its own tracking technologies and subject to its own privacy policy. Please be sure to review their policies and those of the social networks to which you share, if any. When you use these tools, some of your information from the Services (such as the Listing information you selected to Share) may be shared with the Third Party Service and others.

Sharing of Information

We designed are Services, in part, to help you share information with others. So, some of the information generated through the Services will, by its nature, be shared publicly or with third parties.

Public Information About Your Activity on the Services:

Some of your activity on and through the Services is public by default because www.coldbrewcloud.com is, by design, accessible to the general public. Hence, such publicly viewable information may include, but is not limited to, content you have posted on the Site or otherwise through the Services.

Some of this information may be associated with the Accounts of registered users. This will not be the case with unregistered users, but information concerning their use of the Services (such as their browsing history) may be anonymously tracked through the use of cookies and stored by us.

Please keep in mind that by choosing to provide Personal Info using public features of the Services, such Personal Info will be governed by the particular privacy setting of that particular feature, and as such, may be publicly available. Publicly available information means the public, at large, may choose to do things with such information outside of our control. Search engines may index that such Personal Info as well. So, please be careful before including any information you deem to be private in content that you submit through the Services.

IP Address Information:

We do collect and store IP address information but such information is not made public. At times, however, we will share such information with our partners or service providers or vendors, and as otherwise described in this Privacy Policy.

Information You Elect to Share:

You may access Third Party Services through the Services. One example is when you choose to share Personal Info with the Payment Processor in order to make payments for goods in applicable Listings. We are not responsible for the privacy policies and practices of those Third Party Services.

You may elect to share your information with other users through the Services. We strongly advise you to use the utmost care before deciding to share any Personal Info with others, including users. Do not provide any financial information to other individuals, including credit card and bank account information. You are putting yourself at risk.

Aggregate Information:

We sometimes share Aggregate Information with our partners, service providers and other persons with whom we conduct business. We share this type of statistical data so that they can understand how and how often people use our Services and their services or websites. This helps them improve their services and how our Services interface with them. Further, these third parties may share with us non-private, aggregated or otherwise non Personal Info about you that they have independently curated, developed, or acquired.

Electronic Communications with Us:

As part of the Services, you may occasionally receive email and other communications from us, such as communications relating to your Account. We will only send such communication for important purposes related to the Services, such as password recovery.

User Profile Information:

User profile information including your username and other information you enter may be displayed to other users to facilitate user interaction within the Services. We will not directly reveal user email addresses to other users.

Financial Information:

As clearly stated above, we do not currently collect financial information – the Payment Processor does.

However, we may occasionally request (and receive) some of your financial information from our Payment Processor in order to complete transactions you have initiated through the Services, to enroll you in discount, rebate, and other programs in which you elect to participate, to protect against or identifying possible fraudulent transactions, and otherwise as needed to manage our business.

Information Shared with Our Agents:

We employ and contract with people and other entities that do certain tasks on our behalf and who are under our limited control (our “Agents”). Sometimes we may need to share Personal Info with our Agents in order to better provide products or services to you.

Unless we inform you otherwise, our Agents do not have any right to use Personal Info or other information we share with them beyond what is necessary to assist us. You hereby consent to our disclosure of Personal Info to our Agents.

Information Disclosed Pursuant to Business Transfers:

Sometimes, we may choose to buy or sell its own assets. When this occurs, user information is typically one of the business assets transferred. Further, if we or most of our assets are acquired, or if we enter bankruptcy or otherwise cease to conduct business, user information would be one of the assets acquired by a third party. You hereby acknowledge that such transfers may occur, and any such acquirer of us or our assets may continue to utilize your Personal Info as set forth in this Privacy Policy..

Information Disclosed for Our Protection and the Protection of Others:

Sometimes we may need to disclose information we reasonably believe is necessary to (1) comply with an applicable law, rule, regulation, legal process, or request from a government, (2) enforce this Privacy Policy and our Terms of Service, including investigations of any potential violations thereof, (3) stop, detect, prevent, or otherwise address fraud, security or technical issues, (4) respond or otherwise reply to user support requests, or (5) protect our rights, property or safety, our users, and the public. This may include, but is not limited to, giving to and receiving information from third parties for fraud protection.

Information We Share With Your Consent:

Unless stated otherwise, above, you will be notified when your Personal Info may be shared with third parties — you will have an opportunity to prevent such sharing of Personal Info.

Accessing your information

You can generally access information associated with your Account by logging into your Account through the Services.

California Privacy Rights: Under California Civil Code sections 1798.83-1798.84, users who are California residents are entitled to ask us for a notice which identifies the categories of personal customer information which we share with our affiliates and/or third parties for marketing purposes, and which provides contact information for such affiliates and/or third parties. Security of your information

When you create an Account, you must choose a password for your security and privacy. Make sure you choose a strong password. Make sure you do not share your password or allow anyone unauthorized access to your computer if such password is stored electronically. You should sign off the Site after having finished accessing your Account.

We try to protect Account information to ensure that it is kept private; however, we cannot guarantee the absolute security of any Account information. You acknowledge the risk that unauthorized entry or use, hardware or software failure, and other factors, may compromise the security of user information at any time.

We otherwise store all of our information, including your IP address information, using industry-standard practices. Although industry-standard, we do not guarantee or warrant that such practices will prevent unauthorized access to information about you that we store, including Personal Info.

Deleting your account.

If you want to delete your account, email support@coldbrewcloud.com. Once you terminate your Account, you may no longer be able to access information stored on your Account. On the other hand, any public activity on your Account prior to deletion may remain stored on our servers and may remain accessible to other users through the Services and/or the public.

Options regarding your information.

There are many features of the Services you can use without registering. This limits the information you give us.

Remember that you can always choose not to disclose certain information to us. Your access to some features may just be limited.

You can also delete your Account, as explained above.

We can change this Privacy Policy.

We may amend, modify, restate, or otherwise change this Privacy Policy, in whole or in part, from time to time. The use of information we collect now is subject to the version of the Privacy Policy in effect at the time such information is used. Anytime we make changes in the way we collect or use information, we will notify you by posting an announcement on the Services and/or sending you an email. You agree that you, as a user, are bound by any changes to the Privacy Policy when you use the Services after such changes have been first posted to the Site.

Information Stored on Foreign Servers

Sometimes Personal Info may be collected, processed, or stored on servers in countries outside of the United States. Please be aware that such countries have different privacy protections and legal requirements regarding access to your Personal Info.

If you are using the Services in a country with laws governing data collection and use that may differ from U.S. law, you hereby consent to the transfer of your Personal Info and other information to the United States and other countries where we and our service providers operate.
